US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face human smuggling charges, he was detained in immigration custody.
In her decision, the court noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

The judge, who was overseeing his challenge to removal in a Maryland district court, determined that he must now adhere to the terms of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
